Six Vallejo police officers who fatally shot a man in the drive-thru of a taco restaurant will not face charges in connection with the shooting after a special prosecutor assigned to investigate the incident determined the officers were legally justified.
The announcement came following a lengthy investigation by Michael Ramos, a former Santa Barbara County district attorney who was tapped by officials in Vallejo to serve as a special prosecutor in the case.
McCoy, who was also known as Willie Bo, was shot more than 50 times in February 2019 after police were called to a report of a man sleeping in the drive-thru of a Taco Bell restaurant. McCoy had a gun in the vehicle at the time of the incident.
When officers arrived, they activated their body cameras and called for McCoy to show his hands for several minutes. At one point, McCoy moved in a manner that police interpreted as him reaching for the firearm. The shooting began about 10 seconds after he started moving, according to an account published by the New York Times.
McCoy’s family sued the Vallejo Police Department in mid-2019. The lawsuit is still working its way through the court system.
Last October, one officer was fired for his role in the incident and a second police shooting after an internal investigation revealed the officer did not follow safety policies.
